Have you been injured? You may be wondering “Do I Need a Lawyer?” It’s one of the most common questions we get.
One of the most common questions I get as a lawyer is, “Do I need a lawyer?”
So here are a couple of considerations.
If after your crash, you did not need to go to the hospital and you only have property damage to deal with, then you may not need a lawyer.
If you went to the hospital and you were treated and released with no further follow up care, then you may not need a lawyer.
If you do decide to handle your own claim, know that you have three years from the date of the collision to settle your claim or file a lawsuit.
Do not be intimidated by adjusters who try to strong-arm you into settling your claim before you are ready, or who tell you they’re going to close your file.
If you are unable to reach an agreement with the adjuster for an amount for your claim, you still have the option to file a complaint in small claims court, for up to $10,000.
The Mecklenburg County Court website has all of the forms and the instructions.
Now on the other hand, if you were admitted to the hospital following your crash, or you were sent to another doctor or specialist for follow-up, if you need surgery, or if your medical care is otherwise complicated, then you likely need a lawyer.
